Terms
Echoes Terms of Service
Date: 4 October 2026. Version: [terms-v1-draft].
1. About these terms
These terms are the agreement between you and us about using the Echoes app. Please read them. The most important points are in the box below.
The main points
- Echoes helps you record your life story. Your recordings and photos stay on your iPhone or iPad unless you print, share or save a copy.
- Ellie, who asks the questions, is a computer voice, not a real person. When you talk with her, your words are sent to two AI companies, xAI and ElevenLabs [location of ElevenLabs' contracting company to verify; xAI is in the United States]. We only do this if you say yes.
- Echoes does not keep a copy of your recordings. If you lose your iPhone or iPad, or it breaks, and you have no backup, your recordings are gone. Please keep copies.
- Your stories belong to you. You are responsible for what you say about other people.
- Your first 3 stories are free. To record more, you need a subscription through Apple. You can cancel at any time in your Apple settings.
- If your subscription ends, you keep everything you have put in. Nothing is deleted. You can still listen to your recordings and any audiobook you have made, save your original recordings, print or export a plain copy of your stories, and order a printed book. You cannot record or write anything new, or make a new audiobook, until you subscribe again.
- You keep your legal rights as a consumer. Nothing in these terms takes them away.
2. Who we are
Echoes is run by Echoes App Ltd, a company registered in [Scotland] with company number [company number]. Our registered office is [registered office address].
- Email: support@echoes-app.ai
- Post: [postal address for letters]
In these terms, "we", "us" and "our" mean Echoes App Ltd. "You" means the person using Echoes.
3. Some words we use
- Echoes means the Echoes app for iPhone and iPad.
- Ellie is the computer voice in Echoes that asks the questions.
- AI (artificial intelligence) means computer software that can write or speak replies.
- Your stories means everything you add to Echoes: your recordings, the words typed up from them, words you type, titles, and the photos and videos you add.
- Consumer means a person using Echoes for their own private purposes, not for a business.
4. What Echoes is, and what it is not
What Echoes does
- Ellie asks you questions about your life.
- You answer out loud, or you type.
- Echoes records your voice and types up your words on your iPhone or iPad.
- You can add photos and videos, play your stories back, print them at home, share a copy, or order a printed book.
What Echoes is not
- It is not a backup or storage service. We do not keep a copy of your stories.
- It is not medical, legal, financial or other professional advice.
- It is not a will. A wish you record in Echoes does not decide who inherits anything.
- It does not check, edit or approve your stories.
5. Ellie is a computer, not a person
Ellie is a computer voice. She uses AI to choose her questions and to reply.
- Her replies are written by Grok, an AI service run by xAI, a company in the United States.
- Her voice is made by ElevenLabs, another company. It turns her written words into speech.
- Ellie can get things wrong, mishear you, or say something unsuitable. Do not rely on her for facts, advice or decisions.
- If something Ellie says upsets you, stop the conversation and tell us at support@echoes-app.ai.
Ellie only works if you say yes to sending your words. If you say no, you can still record, write, play and print. Our Privacy Policy explains exactly what is sent.
6. Who can use Echoes
- You must be 18 or over to use Echoes.
- Echoes is for your own private use. You may not use it to run a business, for example recording other people's stories for money.
- If you are setting Echoes up for someone else (for example a parent), please hand the iPhone or iPad to them for the screens that ask for a yes. The choices about their stories must be theirs. Please make sure they have seen the main points in section 1.
- If the person recording their story finds decisions difficult, please do not say yes on their behalf to sending their words. Talk to us first at support@echoes-app.ai.
7. Free stories and subscriptions
- Free: your first 3 stories are free. After you have used them, Ellie can still talk with you for 3 more visits. A visit is one time you open Talk and talk with her. At the start of each of these visits she tells you how many are left. After the third, she stops asking questions and Echoes shows you the plans.
- Subscription: to record more, you need a subscription. It costs £14.99 a month or £99.99 a year [confirm prices, including VAT, as set in App Store Connect].
- Through Apple: you buy and manage subscriptions through Apple's App Store using your Apple Account. Apple takes the payment.
- It renews automatically. Your subscription carries on, and Apple charges you again at the end of each month or year, until you cancel.
- How to cancel: open the Settings app on your iPhone or iPad, tap your name, then tap Subscriptions [check the current Apple path]. Cancel at least 24 hours before the renewal date to avoid the next charge. Deleting Echoes does not cancel your subscription.
- Refunds: Apple handles refunds. You can ask Apple for a refund through its Report a Problem service. You have legal rights if Echoes does not work as it should (see section 13).
- If your subscription ends (because you cancel, or a payment fails):
- You keep everything you have put in. Your stories, recordings, words and photos are not deleted. They stay on your iPhone or iPad.
- You cannot record or write any more stories until you subscribe again. If you have not used all 3 of your free stories, you can still record or write those. Talking with Ellie follows the same rule as for free stories above: 3 more visits, then she stops asking questions until you subscribe again.
- You can print or export a basic copy of your stories. "Basic" means [a plain PDF of your words and photos. It is not interactive. Your recordings stay on your iPhone or iPad].
- You can still listen to your recordings and your audiobook, and save copies of your original recordings.
- You can keep any audiobook you have already made, and you can still order a printed book. You cannot make anything new, including a new audiobook, until you subscribe again.
- You can still delete any story, or delete everything.
- Copies you have already printed, shared or saved outside Echoes are not affected.
- When you subscribe again, everything works as before.
- Your stories are only on your iPhone or iPad. If it is lost, or you delete Echoes, they are gone (section 12).
-
We will remind you before your subscription ends [mechanism to confirm], so you can save copies first.
-
Price changes: Apple will tell you before a price goes up and, where Apple's rules require, ask you to agree. If you do not agree, the subscription ends at the end of the period you have paid for.
Full details are in our Subscription Terms [link when live].
8. Printed books
You can order a printed, bound book of your stories:
- £149.99 for words only, delivery included;
- £249.99 for words and photos, delivery included.
Echoes App Ltd is not registered for VAT, so no VAT is charged on books [accountant to confirm]. We deliver to addresses in [the UK only?].
Books are ordered outside the App Store. We (Echoes App Ltd) take the payment ourselves, through our payment provider [payment provider name]. We only charge you after we confirm your order. Books are made just for you, so the usual 14-day right to change your mind does not apply once we confirm your order. You still have full rights if a book is faulty. See our Print Order Terms [link when live].
9. Your stories are yours
- You own your stories. We do not claim ownership of your recordings, your words, or the photos and videos you add.
- If the law gives us any rights in your recordings or in the typed-up words (for example, because our app made the recording), we give those rights to you.
- The permission you give us is narrow. You let us use your stories only:
- to send your words to xAI and ElevenLabs when you use Ellie or 'Auto proof read', if you have said yes;
- to make and deliver a printed book when you order one;
- to deal with a question or complaint you raise with us;
- when the law requires it.
- We will not use your stories for advertising, publicity, or to train AI, and we will not sell them. If we ever want to use them in any other way, we will ask you first. Saying no will only turn off that new feature.
- Our part: the Echoes app, Ellie's questions, her script and voice clips, and the book designs belong to us. You may use them with your stories for your own private purposes, including in your printed book and in copies you share with family and friends.
- Ellie's replies: we do not claim to own Ellie's replies or the tidied words from 'Auto proof read'. You may use them freely with your stories.
10. Your responsibilities: what you say, record and share
In short: what you say and share is yours, and so is the responsibility
You are the author and publisher of everything you say, write, record and add in Echoes, and of everything you send from it. We do not read, monitor, check, edit or endorse your stories, and we are not their publisher or editor. You promise that you have the right to use everything you include, and that nothing you say about anyone is unlawful. You choose who gets your stories, and you are responsible for what happens after that, including if someone passes a story on or posts it on social media. Once a story leaves Echoes, we cannot control it and we are not responsible for it. If your content or your sharing leads to a claim against us because you broke these terms or the law, you will cover our reasonable costs, unless we were at fault. Anyone can report content to us, and we may remove it or turn off a link. Nothing here takes away your legal rights as a consumer.
10.1 You are the author and the publisher. Everything you say, write, record or add in Echoes is your content. That includes your recordings, the words typed up from them, words you type, titles, photos and videos, and anything you send to anyone from Echoes. You are its author. When you print it, send it, share it or play it to anyone, you are its publisher. You alone decide what to include, whether to keep it, and who to send it to.
10.2 We do not monitor, check, edit or endorse your content. We do not read, listen to, monitor, check, edit, approve or endorse your stories, before or after you keep, print or send them. We have no general duty to monitor them and we do not do so. The only exception is where the law requires us to take a particular step, such as acting on a report about a story (10.13 and 10.14). Your stories are not our views. We are not their publisher or editor. 'Auto proof read' and typing up are tools that you choose to use. You decide whether to keep any change, and they do not check whether what you say is true, fair or lawful. Ellie's questions are prompts only. You decide what to say.
10.3 Our role: we store and pass on what you supply. Where Echoes stores or passes on your content at your request, we do this only as a technical service for information that you supply. For example, we pass your words to Ellie's suppliers, and, when sharing is available, we hold a story so that a private link works. We do not choose the content, change it, or choose who receives it. Most of the time we hold none of your stories at all, because they stay on your own iPhone or iPad. [Solicitor to verify: this clause is meant to protect our position as a host under regulation 19 of the Electronic Commerce (EC Directive) Regulations 2002, as a website operator under sections 5 and 10 of the Defamation Act 2013 (England and Wales), as a person who is not the author, editor or publisher under section 3 of the Defamation and Malicious Publication (Scotland) Act 2021, and as an intermediary for copyright purposes.]
10.4 Your promises. Each time you add content to Echoes, or send it to anyone, you promise that:
- you own everything in it, or you have permission from the owner, or the law allows you to use it in this way;
- anyone whose voice you recorded, or who can be clearly seen in a photo or video, has agreed, or would reasonably expect it;
- nothing in it is unlawful about anyone. In particular, it does not state anything untrue that seriously harms a living person's or a business's reputation. It does not reveal anyone's private or confidential information unfairly, and it does not break a court order;
- it is not threatening, abusive, harassing or grossly offensive, it does not stir up hatred, and it is not otherwise against the law;
- it never includes sexual images of anyone under 18;
- you will tell the people you send it to that it is private and must not be passed on without your permission.
10.5 Our Acceptable Use Policy. Please also follow our Acceptable Use Policy [link when live]. In short:
- only record yourself, or people who have said yes to being recorded;
- do not add things you do not have the right to use;
- think about the people in your stories, especially children, before you print or share;
- do not use Echoes to break the law, harass anyone, or try to break or copy the app.
10.6 Copyright, including after you send a story. Music, songs, album covers, book pages, films, TV, radio, photos and other people's writing usually belong to someone else. Naming them in a story is fine. Copying them is different. If your content includes someone else's material, you are responsible for it, wherever it ends up. For example: you privately send your daughter a story with a photo of an album cover in it, and she posts it on Facebook, and the owner complains or Facebook issues a copyright strike. As between you and us, that is your responsibility, not ours. The complaint is a matter for the owner, the person who posted it, the platform and you.
10.7 Defamation and offence, including after you send a story. Honest memories and opinions are part of a life story. But stating something untrue as a fact, in a way that seriously harms someone's reputation, can be defamation. Sending something threatening, abusive or grossly offensive can be a crime, even in private and even to family. You are responsible for what you say about anyone and to anyone, including in a story you send to the person it is about or meant for. If someone you send a story to forwards it to the person it is about, plays it to others, or posts it on Facebook or anywhere else, then as between you and us, that is your responsibility, not ours. We are not the author, editor or publisher of your story.
10.8 You choose who receives your stories, and you are responsible for what they do. You alone choose who receives your stories. As between you and us, you are responsible for that choice and for anything the people you send them to do with them. That includes passing them on, recording them, posting them on social media, or sending them to many people. Before you send a story, tell the people you send it to that it is private and must not be passed on without your permission. When sharing is available, Echoes will show each listener a notice saying the same thing (see the sharing block below). The notice supports your message to them; it does not replace it.
10.9 Once content leaves Echoes, we have no control over it and no responsibility for it. Once a copy of your content has left Echoes, or once someone has heard it, we cannot get it back, delete it, or stop it being copied, recorded, forwarded or posted. Copies outside Echoes are not covered by our deletion, our 30-day deletion queue, or turning off a link. Other services, such as email, Messages, Facebook and other social media, have their own terms. We are not responsible for copies outside Echoes or for what anyone does with them.
10.10 What we remain responsible for. We are responsible for our own failures. That includes if Echoes does not work as it should, if we do not use reasonable care and skill, or if we do not do what these terms say we will do (for example, turning off a link when you ask). Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for your legal rights as a consumer (see section 13).
10.11 Your responsibility for claims caused by your content or sharing. [Solicitor to choose Option A or Option B.]
Option A (narrow indemnity). If someone else makes a claim against us because of your content, or because of the way you chose to send or share it (including where someone you sent it to passed it on), and the claim arises because you broke these terms or the law, you will cover our reasonable losses and reasonable legal costs that result. This does not apply to the extent that our own fault caused or contributed to the loss, or to any loss we could reasonably have avoided or reduced. If this happens, we will tell you promptly and give you the chance to respond and to help deal with the claim. We will not settle it without asking you first, unless the law or a court requires us to act quickly. We will keep the costs down and only ask you for an amount that is fair and in proportion to what happened.
Option B (softer alternative). If you break these terms or the law with your content, or in the way you send or share it, you are responsible for loss that we suffer as a foreseeable result, in the same way that we are responsible to you under section 13. This does not apply to the extent that our own fault caused or contributed to the loss.
10.12 Our permission to use your content stays narrow. You give us only the permission described in section 9, which is what we need to run Echoes for you. We do not publish your stories, and we do not use them for advertising or publicity, to train AI, or for any other purpose.
10.13 Reporting content: notice and takedown. Anyone can report content made with Echoes to us at support@echoes-app.ai. To help us act quickly, please tell us:
- your name and how to contact you;
- where the content is: for example the link, or which book order or story it is;
- what is unlawful or harmful about it, and why (for example: it is untrue about you, it is private, it threatens someone, or it copies your work).
10.14 What we may do when we receive a report. We will look at each report fairly and promptly. We may turn off a link, remove content we hold, or pause or refuse a printed book order, for a short time or for good, if we reasonably believe the content may be unlawful, may break these terms, or may cause serious harm. We do not edit content. We either leave it, or remove it or turn it off. Unless the matter is urgent or the law prevents it, we will tell you about the report and give you a chance to respond, and you can ask us to look again at our decision. We have no duty to monitor content, and we act on what we are told. We may report illegal content to the police where the law requires or allows it. Today we usually hold no copy of your stories, because they stay on your own iPhone or iPad. We will explain that to anyone who reports one.
10.15 We may suspend use that harms others. If Echoes is used to harm, harass, threaten or defame other people, or to break the law, or if you seriously or repeatedly break this section, we may refuse print orders, turn off your links, stop you sharing, or suspend or close any account you have with us (Echoes has no accounts today). Unless the matter is urgent or illegal, we will tell you first and give you a chance to put it right.
10.16 Your legal rights. Nothing in this section takes away your legal rights as a consumer, or limits what we must do by law.
Draft note for the solicitor (not part of the terms; delete before going live). Why prompt action on notice matters: a host that stores information supplied by users is not liable for it in damages if it does not know the content is unlawful and, once it finds out, acts quickly to remove it or turn it off (Electronic Commerce (EC Directive) Regulations 2002, reg 19 [solicitor to verify]). A notice that gives the sender's name and address, where the content is, and why it is unlawful is likely to count as "actual knowledge" (reg 22 [solicitor to verify]), which is why 10.13 asks for exactly those details. Monitoring is not required, and a promise to monitor could create knowledge and duties we do not want, so 10.2 says we do not monitor except as the law requires (the Online Safety Act 2023 [solicitor to verify] is likely to apply once sharing exists). Defamation: as a website operator, Echoes keeps the s.5 defence by following the notice-of-complaint steps in the Defamation (Operators of Websites) Regulations 2013 [solicitor to verify]; s.10 limits claims against anyone who is not the author, editor or publisher where the author can reasonably be sued (Defamation Act 2013, ss.5 and 10, England and Wales [solicitor to verify]); in Scotland, Echoes relies on not being the author, editor or publisher (Defamation and Malicious Publication (Scotland) Act 2021, s.3 [solicitor to verify]). Copyright: the reg 19 hosting defence also covers damages for copyright infringement, but a court can still order a service provider with actual knowledge to stop infringement (Copyright, Designs and Patents Act 1988, s.97A [solicitor to verify]). These terms bind only the user and us. They cannot stop a recipient, the person written about, or a rights owner from making a claim against Echoes; they give us the defences above and a claim against the user. Echoes stays the author of Ellie's own words, so these defences may not cover them.
11. Other companies
- Apple runs the App Store and takes subscription payments. Apple's own terms apply to your Apple Account and purchases.
- xAI and ElevenLabs provide Ellie's replies and voice, as our suppliers.
- [Print partner name] prints and sends our books, as our supplier.
- [Payment provider name] processes card payments for printed books, which we take ourselves.
- When you print, share or save a copy (for example through email, Messages or Files), it goes where you send it. Those services have their own terms. We are not responsible for what happens to a copy once you send it.
12. Keeping your stories safe
- Your stories are kept on your iPhone or iPad, inside Echoes.
- We do not keep a copy. If you lose your iPhone or iPad, it breaks, or you delete Echoes, your stories are gone unless you have a copy.
- To keep a copy:
- turn on iCloud Backup in your Apple settings;
- use [the export button, exact label to confirm] to save your recordings and words to Files or another place (if your subscription has ended, you can export a basic copy; see section 7);
- order a printed book.
- If your iPhone or iPad backs up to iCloud, Apple may keep a copy of Echoes as part of that backup, under Apple's terms.
- We cannot open a locked iPhone or iPad, and we cannot help anyone guess a passcode.
13. If something goes wrong: our responsibility to you
Your legal rights
- As a consumer you have legal rights. In particular:
- digital content (like Echoes) must be of satisfactory quality, fit for purpose and as described;
- services must be provided with reasonable care and skill.
- If Echoes does not meet these standards, you may be entitled to a repair, a replacement, or some or all of your money back.
- If faulty digital content we supplied damages your device or other digital content, and this happened because we did not use reasonable care and skill, we will repair the damage or pay you fair compensation.
- For more about your rights, contact Citizens Advice (in Scotland, Advice Direct Scotland) [verify names before publishing].
What we are responsible for
- If we break these terms, or fail to use reasonable care and skill, we are responsible for loss or damage you suffer that was a foreseeable result. "Foreseeable" means that it was an obvious consequence, or that you and we both knew it might happen when you started using Echoes.
- We are not responsible for loss that was not foreseeable.
- Echoes is for private use. We are not responsible for loss of business, profit or business opportunity.
What we never limit We do not exclude or limit our responsibility for:
- death or personal injury caused by our negligence;
- fraud or fraudulent misrepresentation;
- breaking your legal rights as a consumer;
- anything else the law does not let us exclude or limit.
Some honest limits
- Ellie can be wrong. Do not rely on what she says for facts or advice.
- Typing up is done by computer and can contain mistakes. Your recording is the true version.
- We are not responsible for loss of stories that you could have prevented by keeping a copy, or that were caused by something outside our reasonable control (for example a fault in your device or in Apple's systems), unless we caused it.
14. Keeping Echoes working and updating it
- We aim to keep Echoes working but cannot promise it will always be available. Ellie needs the internet and our suppliers' services.
- We may update Echoes:
- to fix problems or improve security;
- to reflect changes in the law or in Apple's rules;
- to change suppliers;
- to improve features.
- If an update would make Echoes noticeably worse for you (more than a small amount), we will tell you in the app first. You can then end your subscription. Subscriptions are billed by Apple, so we will help you ask Apple for a refund [solicitor to confirm the mechanism].
- We will not use an update to take away your ability to listen to, export, save or delete stories you have already made. You can always delete any story.
15. Changes to these terms and to how we use your information
When we may change these terms We may change these terms only for a good reason, such as:
- a change in the law, or in guidance from a regulator;
- a change in Apple's rules;
- a new feature, or a feature we stop offering;
- a change of supplier;
- security reasons;
- correcting mistakes or making the terms clearer;
- a change in price (only as section 7 explains).
How we will tell you
- Small changes that do not make things worse for you (for example clearer wording): we will update the terms in the app and show the date.
- Bigger changes that could make things worse for you: we will tell you in the app at least [30] days before they start, and by email if you have given us your email address. If you do not want to accept them, you can stop using Echoes and cancel your subscription before the change starts. Subscriptions are billed by Apple, so we will help you ask Apple for a refund.
We will ask you, not just tell you We will not use a change to these terms to start using your stories in a new way. Before any new feature sends or keeps your stories, recordings or photos in a new way, we will explain it in the app and ask you. That includes:
- keeping copies on our computers ("in the cloud");
- sharing with other people through Echoes;
- a copy of your voice;
- a new company receiving your words for a different job.
You can say [Yes, I agree] or [Not now]. Saying no will only turn off that new feature. Everything else will keep working. Our Privacy Policy explains this in more detail.
16. Ending this agreement
You can stop at any time
- Stop using Echoes, cancel your subscription in your Apple settings, and delete the app.
- Before you delete the app, save copies of any stories you want to keep.
- To remove everything Echoes holds on your iPhone or iPad, use [Delete everything, exact label to confirm] or delete the app.
- To ask us to delete details you sent us, email support@echoes-app.ai.
We may stop your use of Echoes if you seriously or repeatedly break these terms or the Acceptable Use Policy, or if the law requires it. Unless there is an urgent reason, we will tell you first and give you a chance to put things right. We may also stop offering Echoes altogether. If we do, we will:
- give you at least [60] days' notice where we can;
- refund any part of a payment you made to us for time you have not used (for Apple subscriptions, we will help you ask Apple);
- make sure you can still export your stories before Echoes stops working, where we can.
17. If you die
- Your stories are on your iPhone or iPad. We do not keep a copy, and we cannot open your device.
- Who may use your iPhone or iPad after you die is a matter for Apple's rules (for example, Apple's Digital Legacy) and for the law of inheritance.
- Your stories may be protected by copyright. That passes under your will, or under the law if there is no will. A wish you record in Echoes is not a will.
- If your subscription ends after you die (for example because payments stop), nothing is deleted. Anyone who can open your iPhone or iPad can still listen to your recordings and audiobook, save the original recordings, and print or export a plain copy of your stories (section 7).
- If we hold any of your details (for example for a book order), we will deal with your executor or personal representative when they show us proof. See our After-Death and Voice Keepsake Policy [link when live].
- Echoes does not make a copy of anyone's voice. Any future keepsake would need your own clear yes, given by you during your life, under separate terms.
18. Complaints
- If you are unhappy, please tell us at support@echoes-app.ai or write to [postal address].
- We will acknowledge your complaint within [5 working days] and aim to reply in full within [30 days].
- For complaints about your personal information, see the Privacy Policy. You can also contact the Information Commissioner's Office (ICO): ico.org.uk, 0303 123 1113.
- For subscription billing, you can also contact Apple.
- [We are not a member of an alternative dispute resolution scheme. / Name the scheme, if one is chosen.]
19. Which law applies and where to go to court
- These terms are governed by Scots law.
- If you live in England and Wales or Northern Ireland, you may bring a claim in your local courts. You keep any protection given to you by the law where you live.
- If we need to bring a claim against you, we will do so in the courts of the part of the UK where you live.
- Echoes is offered in the United Kingdom only [confirm App Store territories].
20. Apple's terms
These points apply because you got Echoes from Apple's App Store:
- These terms are between you and us, not Apple. Apple is not responsible for Echoes or its content.
- Apple has no duty to provide maintenance or support for Echoes.
- If Echoes does not meet a warranty that applies to it, you may tell Apple, and Apple will refund the price you paid Apple for Echoes (if any). As far as the law allows, Apple has no other warranty duty for Echoes.
- Apple is not responsible for dealing with claims about Echoes, including product liability claims, claims that Echoes breaks a law or regulation, consumer protection claims, or claims that Echoes infringes someone's intellectual property. We are responsible for those, as these terms explain.
- You must not use Echoes in breach of any law that controls exports, or if you are on a government list of restricted people.
- Apple and its subsidiaries may enforce these terms against you as a "third-party beneficiary" (a person who is not a party to a contract but may enforce it).
- Apple's own terms for using apps from the App Store also apply. If they conflict with these terms, Apple's terms apply as far as they cover the point.
21. Other legal points
- If a court decides that part of these terms cannot be enforced, the rest still applies.
- If we do not enforce a term straight away, we can still enforce it later.
- We may transfer this agreement to another company, for example if Echoes is sold, but only if your rights will not be reduced. We will tell you if this happens.
- You may not transfer this agreement to someone else.
- Apart from section 20 (Apple), nobody else has rights under these terms.
End of draft Terms of Service. Version [terms-v1-draft], 4 October 2026.

- It renews automatically. Apple will charge you again at the end of each month or year until you cancel.
- Cancel at any time in the Settings app: tap your name, then Subscriptions [check the current Apple path]. Cancel at least 24 hours before the renewal date to avoid the next charge.
- Deleting Echoes does not cancel your subscription.
- If you cancel, you keep your subscription until the end of the period you have paid for.
- When it ends, you keep everything you have put in. Nothing is deleted. You cannot record or write any more stories until you subscribe again. You can still print or export a basic copy of your stories [a plain PDF of your words and photos; recordings stay on your iPhone or iPad]. You can still listen to your recordings and any audiobook you have already made, save copies of your original recordings, and order a printed book. You cannot make anything new, including a new audiobook. If you have not used all 3 of your free stories, you can still record or write those.
- Your recordings stay on your iPhone or iPad. A subscription does not include a backup. Please keep copies.
- Terms: [Terms of Service link when live]. Privacy: [privacy policy web address when live].
Buttons on the subscription screen: [Subscribe monthly, £14.99] [Subscribe yearly, £99.99] [Not now]. Use the exact prices Apple shows, not a hard-coded figure.
More detail
- Who you pay. You pay Apple, through your Apple Account. Apple's terms apply to the payment.
- Free stories. Your first 3 stories are free and do not need a subscription. There is no free trial of the subscription [unless one is set up in App Store Connect; if so, state its length and what happens when it ends].
- Changing plans. You can switch between monthly and yearly in your Apple subscription settings. Apple decides when the change takes effect.
- Refunds. - Apple handles refunds. You can ask through Apple's Report a Problem service. - When you start a subscription you ask for it to begin straight away. The law's 14-day right to cancel digital content may then not apply, but Apple's own refund rules do [solicitor to confirm current Apple terms and DMCC cooling-off rules from January 2027]. - Your legal rights if Echoes is faulty are not affected (Terms §13).
- Price changes. Apple tells you before a subscription price goes up. Where Apple's rules require, it asks you to agree. If you do not agree, the subscription ends at the end of your paid period.
- Reminders. [From January 2027, the law is expected to require renewal reminders, for example before a yearly renewal. Confirm whether Apple's emails meet this, or whether Echoes must also send an in-app reminder.] We intend to show an in-app reminder [14] days before a yearly renewal.
- If we stop offering Echoes, or make it noticeably worse, see Terms §14 and §16.
- What happens when a subscription ends. See Terms §7. You keep everything. Only recording and writing stop. You can print or export a basic copy at any time. Before it ends, we will remind you [mechanism to confirm] and suggest saving copies.

3. How ordering works
- Choose. In Echoes you choose the stories and photos for your book, the cover words, and your delivery details.
- Your yes to send your book to us. Before anything is sent, Echoes shows you exactly what will be sent and asks:
Send your book to Echoes for printing? To make your book, we need a copy of the stories, words and photos you have chosen, your name and your delivery address. They go to Echoes App Ltd and to our printing partner, [print partner name], in [country]. Your stories may mention your health, your beliefs or other people. Only include what you are happy to print. We delete our copy within [30] days after your book is delivered, unless you ask us for a reprint. If you say no, nothing is sent and no order is made. Everything else in Echoes keeps working. [Yes, I agree] [Not now]
- Your order is a request. When you tap to order, you are asking to buy a book. There is no contract yet, and we do not charge you.
- Proof. We will send you a proof (a preview of your book) [in the app / by email]. Please check it carefully: names, dates, spelling, photos and page order. You can ask for corrections, or cancel free of charge, until you approve the proof.
- We confirm. When you approve the proof, and we accept your order, we send you a confirmation by email. The contract is made when we send that confirmation.
- Payment. We (Echoes App Ltd) take payment ourselves, only after we confirm your order, through our payment provider [payment provider name] using [payment methods, for example card or Apple Pay]. If payment fails, we will contact you, and we will not print until it succeeds.
- We may decline an order before we confirm it, for example if we cannot print it, or it breaks our Acceptable Use Policy. If we decline, you are not charged.
4. Your right to cancel
- The law usually gives you 14 days to change your mind about things you buy online. That right does not apply to goods made to your own specifications or clearly personalised (Consumer Contracts Regulations 2013, regulation 28(1)(b)). Your book is made just for you from your own stories.
- Before you approve the proof, you can cancel free of charge. This is our own promise.
- After we confirm your order, you cannot cancel just because you have changed your mind, unless we agree. This does not affect your rights if the book is faulty (section 6).
5. Delivery
- We aim to deliver within [number] working days after we confirm your order. If we have not agreed a date, we will deliver within 30 days.
- If we are late, tell us. If delivery was essential by a certain date, or we do not deliver within an extra period you give us, you may end the contract and get a full refund.
- The book is your responsibility once it is delivered to you, or to someone you nominate.
- If your book is lost or damaged before it reaches you, we will replace it or refund you.
6. If your book is faulty
Your book must be of satisfactory quality, fit for purpose and as described (Consumer Rights Act 2015).
What counts as a fault
- Faults we are responsible for:
- printing or binding defects (for example missing or loose pages, smudged printing, a damaged cover);
- the wrong stories or photos;
- mistakes we introduced that were not in the proof you approved.
- Not a fault:
- mistakes that were in the proof you approved (for example spelling in your own words);
- the quality of an original photo you supplied (for example a blurred or low-resolution picture);
- small differences in colour between your screen and the printed page.
Your remedies
- Up to 30 days after delivery: you can reject a faulty book and get a full refund, or ask for a replacement.
- After 30 days, or if you prefer: we will replace the book. If a replacement does not fix the problem, you can have a price reduction or a refund. A refund after the first 30 days may be reduced to take account of use [solicitor to confirm; usually not for the first 6 months].
- If a fault appears within 6 months of delivery, we assume it was there at delivery unless we can show otherwise.
- How to tell us: email support@echoes-app.ai with your order number and a photo of the problem. We pay any return postage. We may not need the faulty book back.
7. What happens to your stories
- We use the stories, photos and details you send only to make, check and deliver your book, and to deal with any problem with your order.
- Our printing partner uses them only on our instructions, under a written contract.
- We do not read your stories except as needed to print them, check a reported problem, or follow the law.
- We delete our copy and the printing partner's copy within [30] days after delivery, unless you ask us to keep it for a reprint. We keep order and payment records for [6] years for tax and legal reasons. See our Privacy Policy.
8. Your content
- You are responsible for what is in your book, including what you say about other people and photos that belong to someone else. See our Acceptable Use Policy.
- You keep ownership of your stories. You give us and our printing partner permission to copy them only to make your book.
- We may refuse to print, or pause, an order that appears to include illegal content or plainly harmful content about someone (Acceptable Use Policy, section 4). If we refuse after you have paid, we will refund you in full.
9. Our responsibility to you
- We are responsible for foreseeable loss caused by our breaking these terms or not using reasonable care and skill.
- We do not limit our responsibility for death or personal injury caused by our negligence, for fraud, or for your legal rights as a consumer.
- If we lose or damage your content while printing, we will reprint at no cost. We do not hold your only copy, because your stories stay on your iPhone or iPad.
10. Complaints and law
Complaints, governing law and courts are as in our Terms of Service (sections 18 and 19).
End of draft Print Order Terms.
Echoes Acceptable Use Policy
Date: 4 October 2026. Version: [aup-v1-draft].
This policy is part of our Terms of Service. It explains what you may and may not do with Echoes. "We" means Echoes App Ltd. "You" means the person using Echoes.
1. Why we have this policy
Echoes is for recording your own life story, in your own voice, for you and your family. Life stories include other people. This policy helps you tell your story fairly, and keeps Echoes safe.
We do not check or approve your stories. You are responsible for what you say and add.
2. Please do
- Record your own story. If you record someone else (for example interviewing a parent), make sure they have said yes to being recorded.
- Think about the people in your stories. Before you print or share, ask yourself: would they be happy to read this? Take extra care with private matters such as someone's health, relationships, sexuality, money troubles or a crime.
- Take extra care with children. Think carefully before you include a child's full name, school, where they live, or photos of them, in anything you print or share.
- Be fair when you talk about living people. Saying something untrue that seriously harms someone's reputation can be "defamation" (the law's word for damaging someone's good name with an untrue statement). Opinion and honest memories are different from stating things as facts.
- Use photos, music and writing you have the right to use. A photo usually belongs to the person who took it. If it is a family photo, that is usually fine for your own book. Ask if you are unsure.
- Keep copies of your stories (see our Terms, section 12).
3. Please do not
- Do not record anyone without their agreement, or secretly.
- Do not add anything illegal. This includes:
- images of children that are indecent or sexual;
- threats;
- content that stirs up hatred;
- private information you have been ordered not to share.
- Do not use Echoes to harass, bully or threaten anyone, or to reveal someone's private information in order to hurt them.
- Do not pretend to be someone else when you talk with Ellie, or record someone else's story as if it were yours, without their agreement.
- Do not copy large parts of other people's books, songs or articles into your stories, unless you have permission.
- Do not try to get Ellie to produce harmful content, for example instructions for crime or self-harm, or content that is sexual, hateful or violent.
- Do not try to break, copy or misuse Echoes. For example, do not:
- take the app apart to get at its code or keys;
- try to get into our suppliers' systems;
- use automated tools to send messages to Ellie;
- overload the service.
- Do not use Echoes for business (for example recording other people's stories for money) without our written agreement.
4. Printed books
We may refuse or pause a printed book order if it appears to include something illegal, or something that could seriously harm someone. Examples:
- indecent images of children;
- material that plainly appears defamatory of a living person;
- private information about someone that a court has ordered must not be shared.
We do not read every book. If we refuse an order, we will tell you why where we can, and you will not be charged (or we will refund you). See our Print Order Terms.
5. Ellie and difficult moments
Ellie is a computer and can get things wrong. If talking about the past becomes upsetting, you can stop at any time.
If you are worried about your safety or someone else's, please call your local emergency number (999 or 112 in the UK, 911 in the US), or [signposting organisations and numbers, verified before publishing].
6. If someone is worried about a story
If you think a story made with Echoes is about you and is unfair or harmful, contact us at support@echoes-app.ai.
- In most cases we do not hold the story; it is on the storyteller's own iPhone or iPad.
- We will explain what we can do. If it relates to a book order we are handling, we may pause that order while we look into it.
7. If you break this policy
If you seriously or repeatedly break this policy, we may stop you using parts of Echoes, or refuse print orders, as our Terms explain. Unless the problem is urgent or illegal, we will tell you first and give you a chance to put it right. We may report illegal content to the police where the law requires or allows it.
End of draft Acceptable Use Policy.
